fEMBODY Retreats – Waiver, Agreement, and Payment Terms

Introduction & Agreement

By registering for, making any payment toward, or participating in a fEMBODY Retreat (“Retreat”), that’s hosted, offered, or organized by KIANA NG WELLNESS INC. DBA fEMBODY (referred to as “fEMBODY Experiences” and/or “fEMBODY Studio”) I acknowledge that I have carefully read, understood, and voluntarily agree to fEMBODY Retreat’s Participation Agreement, as well as the fEMBODY General Waiver & Release of Liability.

I understand that this Agreement establishes the terms and conditions governing my participation in the Retreat, including payment obligations, cancellation policies, participant responsibilities, assumption of risk, and the release of certain legal claims.

I acknowledge that this Agreement is legally binding upon me, my heirs, executors, administrators, legal representatives, successors, and assigns.

1. Nature of the Retreat

I understand that a fEMBODY Retreat is a group experience that may include, but is not limited to:

• Pole dance instruction
• Fitness, mobility, and wellness activities
• Excursions and recreational activities
• Group transportation
• Shared or private accommodations
• Meals
• Cultural experiences
• Free time
• Independent exploration
• Activities provided by third-party vendors

I understand that the Retreat is designed for the benefit of the group as a whole and that individual preferences, schedules, or circumstances may not always be accommodated.

2. Payment Terms

Deposits

All Retreat deposits are non-refundable.

Except where expressly stated in this Agreement, deposits are not eligible for cash refunds.

Where applicable under the Cancellation & Refund Policy below, a portion of the deposit may instead be converted into a non-transferable fEMBODY credit.

fEMBODY Credits:

Where this Agreement provides for a fEMBODY Credit:

• Credits are valid for one (1) year from the date they are issued.
• Credits are non-transferable and may only be used by the original participant.
• Credits must be redeemed toward a single purchase and may not be split across multiple bookings, events, products, or services.
• Credits have no cash value and may not be redeemed for cash.
• Credits may be combined with promotional offers only if expressly approved by fEMBODY.
• Unless otherwise required by law, expired credits will not be extended or reissued.

No Partial Refunds

I understand that no refunds, credits, discounts, or price reductions will be provided for any unused portion of the Retreat, including but not limited to:

• Voluntary early departure;
• Late arrival;
• Missed flights or transportation;
• Missed meals;
• Missed classes, workshops, or excursions;
• Choosing not to participate in scheduled activities;
• Illness or injury that prevents participation;
• Weather-related itinerary changes;
• Changes resulting from force majeure events; or
• Any other unused portion of the Retreat after it has commenced,

except where expressly stated elsewhere in this Agreement or where required by applicable law.

Payment Terms

If I choose a payment plan, I agree to make all scheduled payments by their respective due dates as outlined in my booking confirmation.

If any scheduled payment becomes more than seven (7) days overdue, fEMBODY reserves the right, in its sole discretion, to cancel my booking and forfeit my place on the Retreat.

All outstanding balances must be paid in full no later than forty-five (45) days before the Retreat start date.

Failure to complete payment by this deadline will be treated as a late cancellation and handled in accordance with the Cancellation & Refund Policy below.

3. Cancellation & Refund Policy

All cancellation requests must be submitted in writing.

Cancellation 90 Days or More Before the Retreat Start Date

• A cancellation fee of USD $250 will be deducted from my deposit.
• The remaining balance of my deposit will be converted into a fEMBODY credit.
• Any payments made beyond the deposit will be refunded to my original payment method.

Cancellation 45–89 Days Before the Retreat Start Date

• A cancellation fee of USD $400 will be deducted from my deposit.
• The remaining balance of my deposit will be converted into a fEMBODY credit.
• Any payments made beyond the deposit will be refunded to my original payment method.

Cancellation 44 Days or Less Before the Retreat Start Date

• My deposit is fully non-refundable.
• Any payments made beyond the deposit will be converted into a fEMBODY credit that may be applied toward eligible future online or in-person fEMBODY products, services, or events.

No-Show

Failure to attend the Retreat without providing written notice before the official Retreat start date will be considered a no-show.

In the event of a no-show:

• My deposit will be forfeited.
• All additional payments will also be forfeited.
• No refunds or credits will be issued.

Retreat Cancellation by fEMBODY

fEMBODY reserves the right to cancel, postpone, modify, or reschedule a Retreat for any reason, including but not limited to insufficient enrollment, safety concerns, force majeure events, travel disruptions, venue issues, instructor availability, or other circumstances beyond fEMBODY’s reasonable control.

If fEMBODY cancels a Retreat before its scheduled start date, I may transfer all payments made (excluding my non-refundable deposit) toward another eligible fEMBODY Retreat, event, product, or service.

Refunds of deposits or other payments may be offered at fEMBODY’s sole discretion on a case-by-case basis.

I acknowledge that fEMBODY is not responsible for any incidental, consequential, or out-of-pocket expenses arising from my booking or the cancellation of a Retreat, including but not limited to:

• Airfare
• Hotel accommodations booked independently
• Ground transportation
• Passport or visa expenses
• Vaccinations
• Currency exchange losses
• Travel insurance deductibles or premiums
• Excursions booked independently
• Lost wages
• Any other personal expenses.

Refund Processing

Where a refund is approved under this Agreement, I understand that processing times may vary depending on my financial institution and payment provider.

Approved refunds may take up to fourteen (14) days to appear in my original payment method.

4. Assumption of Additional Risks

In addition to the risks described in the General Waiver, I acknowledge that Retreat participation involves additional risks, including but not limited to:

• Domestic and international travel
• Air travel and airport procedures
• Delayed, cancelled, or missed flights
• Customs, immigration, and security screening
• Lost, delayed, or damaged baggage
• Transportation by buses, taxis, rideshares, ferries, boats, trains, or other vehicles
• Different medical standards and emergency response systems
• Food allergies or foodborne illness
• Weather and natural hazards
• Water activities
• Hiking or uneven terrain
• Crime or theft
• Political or civil disruptions
• Language barriers
• Local laws and customs
• Acts or omissions of third-party vendors
• Physical, emotional, or mental fatigue associated with travel

I voluntarily assume all such risks.

5. Personal Responsibility

I understand that I remain solely responsible for my own decisions, actions, conduct, health, and wellbeing throughout the Retreat.

This includes responsibility for:

• My passport, visas, identification, and travel documents
• Meeting airline baggage requirements
• Arriving at airports, transportation departures, activities, and meeting points on time
• Monitoring airline announcements and boarding times
• Managing my medications
• Communicating allergies, dietary restrictions, or medical conditions
• Following local laws
• Respecting accommodations and property
• Exercising reasonable judgment throughout the Retreat

6. Role of Retreat Leaders

I understand that fEMBODY retreat leaders and staff are responsible for organizing and facilitating the overall Retreat experience and coordinating the published itinerary for the group.

I acknowledge that retreat leaders are not personal assistants, travel agents, medical providers, security personnel, legal advisors, childcare providers, or one-on-one companions.

While retreat leaders may choose to assist participants when reasonably able, they are under no obligation to provide individualized services, supervision, accommodations, or logistical support beyond the scope of the Retreat.

7. Participant Communication

I agree to remain reasonably reachable throughout the Retreat using the communication methods designated by fEMBODY, including group messaging platforms where applicable.

If I choose to leave the group, miss a scheduled meeting time, experience delays, or encounter an emergency, I agree to notify a retreat leader as soon as reasonably possible.

I understand that retreat leaders may continue scheduled transportation, activities, or the itinerary if I fail to communicate or arrive on time.

8. Alcohol, Drugs, and Personal Conduct

I acknowledge that I am solely responsible for my consumption of alcohol, recreational drugs, prescription medications, and any other substances.

I understand that fEMBODY does not monitor or supervise my consumption of alcohol or other substances.

I accept full responsibility for any consequences resulting from my decisions, including but not limited to:

• Injury
• Illness
• Medical emergencies
• Missed activities
• Missed transportation
• Denied boarding
• Arrest
• Detention
• Property damage
• Financial losses
• Harm to myself or others

I understand that intoxication, illegal drug use, unsafe behavior, harassment, violence, discrimination, or conduct that negatively impacts the safety or experience of others may result in immediate removal from the Retreat without refund.

9. Code of Conduct

To help create a safe, respectful, and supportive environment, I agree to:

• Treat all participants, retreat leaders, staff, local guides, vendors, and community members with respect.
• Follow safety instructions provided by retreat leaders and third-party providers.
• Respect the privacy, boundaries, and personal space of others.
• Obtain consent before photographing or recording other participants for personal use.
• Respect local customs, cultures, laws, and communities.
• Refrain from behavior that is abusive, discriminatory, threatening, harassing, disruptive, or otherwise detrimental to the group experience.

I understand that failure to comply with these expectations may result in my removal from part or all of the Retreat without refund.

10. Travel and Transportation

I understand that transportation providers, airlines, hotels, excursion operators, restaurants, and other travel suppliers are independent third parties.

fEMBODY is not responsible for:

• Flight delays
• Flight cancellations
• Missed flights
• Airline schedule changes
• Airline overbooking
• Lost or delayed baggage
• Transportation disruptions
• Immigration or customs decisions
• Airport security delays
• Passport or visa issues
• Mechanical failures
• Weather-related disruptions
• Acts or omissions of transportation providers

I acknowledge that any resulting expenses are my sole responsibility unless otherwise expressly agreed in writing.

11. Group Travel Expectations

I understand that the Retreat follows a planned itinerary intended for the benefit of the group.

If I become separated from the group due to my own actions, delays, missed transportation, airport security procedures, customs or immigration processing, airline decisions, personal choices, illness, or any circumstance outside fEMBODY’s reasonable control, I understand that the Retreat may continue as scheduled.

I acknowledge that fEMBODY is not required to delay flights, transportation, activities, or the group’s itinerary for an individual participant.

If I become separated from the group, I am solely responsible for all costs associated with rejoining the Retreat unless fEMBODY expressly agrees otherwise.

12. Personal Expenses

Unless expressly stated otherwise in writing, I understand that I am solely responsible for all personal expenses, including but not limited to:

• Airfare
• Transportation outside the published itinerary
• Optional activities
• Meals or beverages not specifically included
• Alcoholic beverages
• Snacks
• Souvenirs
• Laundry
• Medical expenses
• Prescription medications
• Passport or visa fees
• Baggage fees
• Gratuities
• Incidental purchases
• Costs incurred due to missed transportation, delayed travel, or personal decisions

13. Free Time and Optional Activities

I understand that portions of the Retreat may be designated as free time or optional activities.

Participation in optional activities is entirely voluntary.

During any free time or activities that I choose independently, I am solely responsible for my own transportation, purchases, safety, decisions, and wellbeing.

fEMBODY does not supervise participants during designated free time.

14. Medical Care

I understand that medical facilities, emergency transportation, medications, and healthcare standards may differ from those available in my home country.

I authorize fEMBODY to seek emergency medical assistance if reasonably necessary; however, I accept full responsibility for all resulting medical expenses and acknowledge that fEMBODY makes no guarantees regarding the availability, quality, or timeliness of medical care.

15. Travel Insurance

I understand that comprehensive travel insurance is strongly recommended.

I acknowledge that I am responsible for obtaining any travel, medical, evacuation, baggage, cancellation, interruption, or other insurance coverage I deem appropriate.

I understand that fEMBODY is not responsible for reimbursing losses that may have been covered by travel insurance.

16. Photography and Media Release

I grant fEMBODY the unrestricted right to photograph, record, film, and otherwise capture my image, voice, likeness, and participation throughout the Retreat.

I authorize fEMBODY to use such photographs, videos, recordings, testimonials, and other media for promotional, marketing, educational, commercial, social media, and other lawful business purposes without compensation or further approval.

I understand that Retreats involve group experiences where incidental appearances in photographs and videos may occur.

If I do not wish to appear in promotional media, I understand that I must notify fEMBODY in writing before the Retreat. While reasonable efforts will be made to accommodate such requests, I understand that fEMBODY cannot guarantee that incidental appearances in group settings can always be avoided.

17. Excursions and Third-Party Activities

Certain Retreat activities may be operated by independent third-party providers.

I understand that these providers are solely responsible for the operation and safety of their own services.

To the fullest extent permitted by law, fEMBODY is not responsible for the acts, omissions, negligence, equipment, decisions, policies, or services of independent third-party providers.

18. Changes to the Itinerary

I understand that Retreat itineraries may change due to weather, safety concerns, participant wellbeing, transportation disruptions, local conditions, force majeure events, or other circumstances beyond fEMBODY’s reasonable control.

I authorize fEMBODY to make reasonable modifications that it believes are in the best interests of participant safety and the overall Retreat experience.

19. Early Departure or Separation

If I voluntarily leave the Retreat, miss scheduled transportation, choose alternative accommodations, or otherwise separate myself from the Retreat before its scheduled conclusion, I understand that I assume full responsibility for my own transportation, lodging, expenses, safety, and wellbeing from that point forward.

No refunds, credits, or reimbursements will be provided unless expressly stated in writing.

20. Conclusion of the Retreat

I understand that fEMBODY’s organized responsibilities conclude at the official end of the Retreat as communicated by the retreat leaders.

Once the Retreat has officially concluded, or once I voluntarily separate from the Retreat before its conclusion, I acknowledge that I am solely responsible for my own conduct, travel, accommodations, transportation, purchases, alcohol consumption, interactions with others, flights, and any resulting consequences.

21. No Guarantee of Individual Experience

I understand that fEMBODY is committed to creating a positive, supportive, and meaningful Retreat experience for all participants.

However, I acknowledge that personal satisfaction, emotional outcomes, interpersonal relationships, compatibility with other participants, weather, travel conditions, accommodations, and other circumstances beyond fEMBODY’s reasonable control cannot be guaranteed.

22. Acknowledgment

By signing this Agreement, I acknowledge that:

• I have carefully read and fully understand this Agreement.
• I understand that travel and Retreat participation involve risks beyond fEMBODY’s control.
• I voluntarily assume those risks.
• I understand and accept my personal responsibilities throughout the Retreat.
• I understand that this Agreement supplements the fEMBODY General Waiver & Release of Liability.
• I voluntarily agree to all terms contained herein.
