Retreat Participation Agreement and Waiver

IMPORTANT — PLEASE READ CAREFULLY. THIS AGREEMENT CONCERNS YOUR PARTICIPATION IN ACTIVITIES THAT INVOLVE RISK AND THE RELEASE OF CERTAIN LEGAL CLAIMS.

1. About This Agreement

This Retreat Participation Agreement & Waiver (“Agreement”) applies to retreats hosted, offered, or organized by KIANA NG WELLNESS INC., operating as fEMBODY, including fEMBODY Experiences and fEMBODY Studio (“fEMBODY,” “we,” or “us”).

In this Agreement, “Retreat” means the fEMBODY retreat for which I register, including activities and services included in that booking.

This Agreement supplements the General Waiver & Release of Liability and should be read together with that waiver and our Terms of Service.

Retreat deposits, payment deadlines, cancellations, refunds, credits, no-shows, and the financial consequences of early departure or removal are addressed in the Retreats section of our Refund & Cancellation Policy.

I understand that I should review these documents before booking and ask for clarification if I do not understand any provision.

Nothing in this Agreement excludes any duty, liability, right, or remedy that cannot lawfully be excluded.

2. Nature and Scope of the Retreat

I understand that a Retreat is a group experience that may include:

  • Pole dance instruction and movement workshops.

  • Fitness, mobility, flexibility, and wellness activities.

  • Excursions, cultural experiences, and recreational activities.

  • Group transportation.

  • Shared or private accommodations.

  • Meals.

  • Free time and independent exploration.

  • Activities delivered by independent third-party providers.

The activities and services included in my particular booking are described on its booking page and in the booking information provided to me. This general list does not mean that every Retreat includes every item.

I understand that the Retreat is organized for a group and that individual preferences and requests may not always be accommodated. This does not limit any accommodation obligations imposed by applicable law.

3. Assumption of Retreat-Specific Risks

In addition to the activity risks described in the General Waiver & Release of Liability, I understand that Retreat participation may involve risks associated with:

  • Physical activity, including falls, strains, sprains, equipment misuse or failure, and other injuries.

  • Domestic and international travel.

  • Air travel, airport procedures, and delayed, cancelled, or missed flights.

  • Customs, immigration, security screening, and entry requirements.

  • Lost, delayed, stolen, or damaged baggage and personal belongings.

  • Travel by buses, taxis, rideshares, ferries, boats, trains, or other vehicles.

  • Different healthcare standards and limited or delayed emergency response.

  • Food allergies, foodborne illness, and exposure to communicable illness.

  • Weather, natural hazards, water activities, hiking, and uneven terrain.

  • Crime, theft, political disruption, or civil unrest.

  • Language barriers, unfamiliar surroundings, and local laws or customs.

  • The acts or omissions of participants, instructors, venues, transportation providers, and other third parties.

  • Physical fatigue, emotional distress, or mental fatigue associated with travel or participation.

These risks may result in injury, illness, disability, property damage, financial loss, or death.

I understand that risks cannot be eliminated entirely. I voluntarily choose to participate and assume the risks of participation to the fullest extent permitted by applicable law.

4. Release of Liability and General Waiver

I acknowledge that the General Waiver & Release of Liability contains provisions concerning assumption of risk, release of claims, indemnification, personal property, property damage, and participant responsibilities.

To the fullest extent permitted by applicable law, I agree that those provisions apply to my Retreat participation.

In particular, I understand that the General Waiver includes a release of claims against the parties identified in it, including claims arising from their ordinary negligence, to the extent such claims may lawfully be released.

This Agreement supplements the General Waiver; it does not replace it or expand any exclusion beyond what applicable law permits.

5. Fitness to Participate and Personal Responsibility

I am responsible for assessing my ability to participate in the activities I choose and for obtaining appropriate medical advice about any condition that may affect my participation.

I agree to:

  • Participate within my abilities and limitations.

  • Follow safety instructions and use equipment only as instructed.

  • Stop participating and notify an instructor or retreat leader if I experience pain, dizziness, illness, injury, or believe an activity is unsafe for me.

  • Manage my medications and personal health needs.

  • Communicate relevant allergies, dietary restrictions, and support needs before the Retreat, and notify fEMBODY of relevant changes.

  • Exercise reasonable judgment throughout the Retreat.

Communicating a request or condition does not, by itself, confirm that a particular arrangement has been made. I should obtain confirmation of any support or accommodation I need before travelling.

6. Travel Documents and Arrival Responsibilities

I am responsible for:

  • Obtaining and carrying valid passports, visas, identification, and other required travel documents.

  • Checking entry, transit, and airline requirements applicable to my circumstances.

  • Meeting baggage requirements.

  • Monitoring airline announcements and boarding information.

  • Arriving at airports, departures, activities, and meeting points on time.

  • Following applicable local laws and venue requirements.

I understand that entry decisions, airline decisions, security procedures, and immigration processing are outside fEMBODY’s control.

7. Role of Retreat Leaders

Retreat leaders organize and facilitate the group experience and coordinate the published itinerary.

Individual assistance, supervision, companionship, or logistical support beyond the agreed scope of the Retreat is not automatically included. Any specific service or arrangement must be confirmed in advance.

Retreat leaders do not replace qualified medical professionals, emergency services, or other professional advisers.

These descriptions of the leaders’ role do not exclude duties that fEMBODY or its staff owe under applicable law.

8. Communication and Group Travel

I agree to remain reasonably reachable through the communication methods designated for the Retreat.

If I leave the group, expect to miss a meeting time, experience a delay, or encounter an emergency, I will notify a retreat leader as soon as reasonably possible. In an emergency, I should also contact appropriate local emergency services.

I understand that the group may continue with scheduled transportation or activities if I am late, unavailable, or separated from the group.

The group may also need to continue if I experience airport delays, customs or immigration processing, airline disruption, illness, or other circumstances outside fEMBODY’s reasonable control.

Unless an expense is included in my booking, otherwise agreed in writing, or payable by fEMBODY under applicable law, I am responsible for the costs of rejoining the group.

9. Conduct, Consent, and Impairment

I agree to:

  • Treat participants, retreat leaders, staff, guides, vendors, and local community members respectfully.

  • Follow reasonable safety instructions.

  • Respect privacy, personal space, and individual boundaries.

  • Obtain consent before photographing or recording other participants for personal use.

  • Respect local communities, cultures, customs, laws, and property.

  • Refrain from harassment, discrimination, threats, violence, abuse, and unsafe or seriously disruptive conduct.

I am responsible for my consumption of alcohol, recreational drugs, prescription medications, and other substances. I will not participate in physical or other safety-sensitive activities while impaired.

I understand that substance use may result in injury, illness, missed transportation, denied boarding, arrest, property damage, financial loss, or harm to myself or others.

fEMBODY may restrict or end my participation where my conduct creates a safety concern or breaches these requirements. The financial consequences of removal are described in the Refund & Cancellation Policy.

10. Transportation, Excursions, and Third-Party Providers

Some transportation, accommodations, meals, excursions, and other services may be delivered by independent third parties.

I understand that such providers control the operation of their own services and may have their own safety requirements or participant agreements.

Travel may be affected by delays, cancellations, overbooking, lost baggage, mechanical problems, weather, security procedures, immigration decisions, or other disruptions.

To the fullest extent permitted by law, fEMBODY does not assume responsibility for the independent acts or omissions of third-party providers. This does not exclude any responsibility that fEMBODY retains under applicable law or its own contractual commitments.

Financial consequences of cancelled or changed services are addressed in the Refund & Cancellation Policy, subject to applicable law.

11. Personal Expenses, Belongings, and Property Damage

Unless expressly included in my booking or otherwise agreed in writing, I am responsible for personal expenses such as:

  • Airfare and transportation outside the included itinerary.

  • Optional activities and independently booked excursions.

  • Meals, beverages, and alcohol not included in the Retreat.

  • Snacks, souvenirs, laundry, and incidental purchases.

  • Medical expenses and prescription medications.

  • Passport, visa, baggage, and other travel charges.

  • Gratuities.

  • Costs arising from missed transportation or personal travel choices.

I am responsible for taking reasonable care of my personal belongings, including valuables, electronics, luggage, identification, and travel documents.

I agree to be financially responsible for damage I intentionally or negligently cause to equipment, accommodations, vehicles, venues, or other property, as provided in the General Waiver and applicable law.

12. Free Time and Independent Activities

During designated free time, I may choose to undertake activities independently.

Unless expressly included and supervised as part of the Retreat, these activities are not supervised by fEMBODY.

I am responsible for assessing their suitability, choosing providers, making arrangements, and managing my transportation, purchases, and personal safety.

I will communicate with retreat leaders where my plans affect my attendance or return to the group.

13. Medical Care and Emergencies

I understand that medical facilities, medication availability, emergency transportation, and healthcare standards may differ from those in my home country.

If reasonably necessary, I authorize fEMBODY to seek emergency medical assistance on my behalf. This authorization does not replace any consent required by treating professionals or applicable law.

I am responsible for medical and emergency transportation costs incurred for my care, except to the extent another person is responsible under applicable law or an applicable insurance policy.

fEMBODY cannot guarantee the availability, quality, or timeliness of third-party medical care.

14. Travel Insurance

Comprehensive travel insurance is strongly recommended.

I am responsible for considering appropriate coverage for medical treatment, emergency evacuation, trip cancellation, trip interruption, baggage, and other travel risks.

I should confirm whether my insurance covers the destinations and activities involved, including pole dance, excursions, and any optional activities I intend to undertake.

Insurance coverage and claim decisions are governed by my insurer’s terms. Obtaining insurance does not change fEMBODY’s contractual or legal obligations.

15. Photography and Media

I grant fEMBODY permission to photograph, record, or film my image, voice, likeness, and participation during the Retreat and to use that material for promotional, marketing, educational, commercial, social media, and other lawful business purposes, without compensation or further approval, subject to applicable law.

If I do not wish to appear in promotional media, I will notify fEMBODY in writing before the Retreat at info@fembodyexperiences.com.

fEMBODY will make reasonable efforts to accommodate those requests. I understand that incidental appearances in group settings may occur.

This provision does not give other participants permission to photograph or record me without my consent.

16. Itinerary Changes and Individual Experience

Retreat itineraries may change because of weather, safety concerns, participant wellbeing, transportation disruption, local conditions, or events beyond fEMBODY’s reasonable control.

fEMBODY may make reasonable changes to support participant safety and the overall group experience. Any resulting cancellation, refund, or credit questions are governed by the Refund & Cancellation Policy and applicable law.

I understand that personal satisfaction, emotional outcomes, relationships with other participants, and particular weather or travel conditions cannot be guaranteed.

This does not remove fEMBODY’s responsibility to provide the services it has agreed to provide, subject to lawful changes and applicable remedies.

17. Early Departure and End of the Retreat

If I voluntarily leave the Retreat, choose alternative accommodations, or otherwise separate from the group, I am responsible for my subsequent independent arrangements and expenses, subject to applicable law.

I will notify a retreat leader where reasonably possible.

The organized Retreat services conclude at the official end communicated in the booking or itinerary information. Services expressly included after that point, if any, remain subject to the booking terms.

Financial consequences of late arrival, early departure, or unused activities are addressed in the Refund & Cancellation Policy.

Leaving or completing the Retreat does not extinguish any rights or obligations that arose before departure or completion.

18. Acknowledgment

When accepting this Agreement, I acknowledge that:

  • I have read and understand this Agreement and the General Waiver & Release of Liability.

  • I understand that Retreat participation involves physical activity, travel, and other risks.

  • I understand that the General Waiver includes the release of certain legal claims.

  • I have reviewed the Retreats section of the Refund & Cancellation Policy.

  • I understand my participation, conduct, communication, and travel responsibilities.

  • I have had the opportunity to ask questions before accepting.

  • I voluntarily agree to the applicable terms.

To the extent permitted by law, this Agreement applies to me and binds my heirs, executors, administrators, and legal representatives.

If any provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
